1. About us
1.1 Global Tutors Pty Ltd, registration number 2025/188667/07, registered at 222 Smit St, Braamfontein, Johannesburg, 2017, trading as Global Tutors, is a tutoring agency.
1.2 We match students with independent tutors, vet those tutors, provide the platform, arrange and support lessons, collect payment, and maintain safeguarding oversight. Lessons are delivered by the tutor as an independent contractor.
1.3 For educational psychology, cognitive and learning assessments, personality evaluation and career guidance, we facilitate an introduction to an independently registered practitioner, who provides that service under their own professional registration.
1.4 These terms apply when you enquire, book, pay for or receive any of our services. If you're booking for a student under 18, you confirm you are their parent or legal guardian and are agreeing on their behalf.
2. Definitions
2.1 "Global Tutors" / "we" / "us" - Global Tutors Pty Ltd.
2.2 "Client" / "you" - the person purchasing our services, including a parent, guardian, adult student or organisation.
2.3 "Student" - the person receiving tutoring.
2.4 "Tutor" - an independent contractor engaged by us to deliver tutoring.
2.5 "Practitioner" - an independently registered professional providing psychology, assessment or guidance services.
2.6 "Session" - a single online tutoring lesson.
2.7 "Platform" - the online classroom and systems we provide, currently Lessonspace.
2.8 "Force Majeure" - an event beyond a party's reasonable control preventing them from meeting their obligations.
3. What we do, and what the tutor does
Global Tutors is responsible for: vetting tutors (identity, qualifications, police check, references); matching you with a suitable tutor; arranging the meet-and-greet; providing the platform and recording sessions; scheduling support and reminders; collecting payment and paying tutors; safeguarding oversight and handling concerns; and rematching you if the fit isn't right.
Your tutor is responsible for: preparing and delivering lessons; lesson content, teaching method and materials; punctuality and professional conduct; marking, feedback and progress notes; complying with our safeguarding and communication rules; and their own tax and business affairs.
If you have a problem with a lesson, come to us. We will address it with the tutor and, where appropriate, rematch you.
4. Practitioner services
4.1 We match you with a practitioner registered with the relevant professional body, and arrange the appointment.
4.2 The practitioner provides the service, forms their professional opinion, keeps the clinical record, and is accountable to their own regulator. We do not supervise or influence their professional judgement.
4.3 We do not request or receive assessment reports from the practitioner - they provide these to you directly. If you choose to send us a copy, we hold it as special personal information under our Privacy Policy and delete it on request.
4.4 We charge you a fee for our own service - matching you with a suitable practitioner and arranging the appointment. That fee is disclosed to you before you book, and it is not a share of the practitioner's fee. The practitioner sets and receives their own fee for the professional service, and we do not take any part of it. You pay the practitioner directly for the service; where we collect the practitioner's fee for convenience, we act only as a payment agent and pass it to them in full.
4.5 If you have a concern about the professional service itself, raise it with the practitioner or their professional body. We will help you make contact.
5. Matching and the Right Tutor Fit Promise
5.1 We aim to propose a matched tutor within 24 hours of your enquiry, and to arrange a free meet-and-greet before you commit.
5.2 Right Tutor Fit Promise: if after your first paid session you feel the tutor isn't the right fit, tell us within 7 days and we will either rematch you with another tutor at no additional cost, or refund that session. This applies once per tutor match and requires that the session took place through our platform.
5.3 This is our promise about our matching service, and it stands regardless of which tutor delivered the lesson.
5.4 If a tutor can no longer continue, we'll arrange a suitable replacement.
6. Booking, scheduling and attendance
6.1 Sessions are booked subject to tutor availability and confirmed by us.
6.2 We send reminders, but attendance is your responsibility.
6.3 Please provide a quiet space, a working device with camera, and stable internet.
6.4 If a tutor is more than 15 minutes late without notice, the session isn't charged.
6.5 Please ensure students under 16 are appropriately supervised - see our Child Protection Policy.
7. Payment
7.1 Lessons are sold as packages. You book and pay for a package at a package rate we agree with you before booking, and payment is made in full in advance - this is how we hold the funds to pay your tutor.
7.2 We separately agree what your tutor is paid - their rate reflects their experience, qualifications, location and the like, and is set with the tutor. What you pay is your agreed package rate; the difference between that and the tutor's fee is our margin, which is not a fixed commission. The split is between us and the tutor.
7.3 Currency and payment method depend on your country and are confirmed at booking.
7.4 We may change prices with at least 7 days' notice. Changes don't affect packages already paid for.
7.5 Overdue invoices may result in sessions being paused.
7.6 Please do not pay a tutor directly. Direct payments are not valid against your account and remove our safeguarding and quality protections.
7.7 A package is a number of prepaid lessons, paid in full in advance. Within a package, one credit equals one 60-minute lesson. Credits are valid for 12 months from the date of purchase, and you are responsible for booking within that period. You may book on any schedule - weekly, twice weekly, or intensively before exams. Refund treatment is set out in section 8.
8. Cancellation, rescheduling and refunds
8.1 24 hours' notice to cancel or reschedule without charge.
8.2 Late cancellations and no-shows will be charged in full.
8.3 We'll arrange a make-up session where a tutor cancels.
8.4 You may stop using our services at any time. Unused prepaid sessions are non-refundable.
8.5 Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008.
9. Recording of sessions
9.1 All sessions are recorded for child protection, quality assurance and dispute resolution, retained for 90 days, and handled per our Privacy Policy.
9.2 An automatic written summary of each session is also generated and retained for 2 years.
9.3 Recording is arranged and controlled by us, not by your tutor.
9.4 Recording is a condition of service - we cannot arrange sessions without it.
9.5 Recordings are never shared publicly or used for marketing. You may request access to a recording of your own sessions while it is still retained.
10. Communication
Our primary channel is WhatsApp. By giving us your number you agree we may contact you there about your bookings, sessions and account. We may create a group for your family that includes your tutor and a member of our team. Everyone in a group can see the other participants' phone numbers. You can ask to be contacted by direct message or email instead at any time. See our Communications Policy.
11. Conduct, and going around us
11.1 Please treat our tutors and staff with respect. We may suspend or end services for abusive, discriminatory or unsafe behaviour, and will do so immediately where a safeguarding concern arises.
11.2 You must not arrange lessons or payment directly with a tutor introduced by us, outside Global Tutors - during our engagement and for 12 months afterwards. This removes our safeguarding, recording, vetting and quality protections.
12. Results
We do not guarantee particular grades, marks, exam results, admissions outcomes, or improvement within any given number of hours. Any figures on our website describing typical progress are general indications drawn from our experience, not promises. Outcomes depend on the student's effort, starting point, school and circumstances.
13. Intellectual property
13.1 Materials we provide remain our property or our licensors', for the student's personal study only.
13.2 Materials a tutor creates remain the tutor's, licensed to you for personal study.
13.3 Please don't copy, resell or distribute either.
13.4 Session recordings and summaries remain our property.
14. Liability
14.1 We are responsible for our own services - vetting, matching, the platform, recording, payment handling and safeguarding - and we provide them with reasonable care and skill.
14.2 Your tutor is responsible for the delivery and content of lessons. We are not liable for a tutor's teaching decisions, but we will act on complaints, rematch you, and remove tutors who fall short.
14.3 The practitioner is responsible for their professional service under clause 4.
14.4 To the extent permitted by law, our total liability arising from our services is limited to the fees you paid us in the 3 months before the claim.
14.5 Nothing limits liability for death or personal injury caused by negligence, for fraud, for our safeguarding obligations, or for anything else that cannot lawfully be limited - including your rights under the Consumer Protection Act.
15. Force majeure
If either of us cannot meet an obligation because of an event beyond our reasonable control, that obligation (other than payment for services already delivered) is suspended until the event is resolved. We'll tell you promptly if this affects your sessions.
16. Termination
16.1 We may suspend or end services if you breach these terms.
16.2 Either of us may end the arrangement by written notice.
16.3 Ending it doesn't affect obligations already incurred, including unpaid invoices.
16.4 Clauses 11.2, 13 and 14 continue to apply afterwards.
17. Privacy and safeguarding
Our Privacy Policy, Child Protection & Safeguarding Policy and Communications Policy form part of these terms.
18. Notices
Notices must be in writing to info@globaltutors.co or 222 Smit St, Braamfontein, Johannesburg, 2017. We'll send notices to the email address or WhatsApp number on your account.
19. Changes and governing law
19.1 We may update these terms and will post the current version here, notifying you of material changes at least 7 days in advance.
19.2 These terms are governed by the law of South Africa, and the South African courts have jurisdiction.
